These Terms of Service govern your use of DailyWell ("the App"). By downloading, accessing, or using the App, you agree to these Terms of Service. If you do not agree, do not use the App.

1. Use of the App

The App is provided for general wellness, lifestyle, and personal reference purposes only. You may use the App only in compliance with applicable laws and these Terms of Service.

You agree not to:

- use the App in any unlawful or harmful manner;

- interfere with or disrupt the operation of the App;

- attempt to access any part of the App or related systems in an unauthorized way;

- copy, modify, reverse engineer, distribute, sell, or exploit any part of the App except as permitted by applicable law.

2. Eligibility

You must be at least the age required under the laws of your jurisdiction to use the App. If you are under the age of majority in your jurisdiction, you should use the App only with the involvement of a parent or legal guardian.

3. Health and Medical Disclaimer

The App is not a medical device and does not provide medical advice, diagnosis, or treatment.

Heart rate results and other wellness information provided by the App are for general informational and personal reference purposes only. Results may be affected by device limitations, lighting conditions, movement, finger placement, and other factors.

You should not rely on the App for medical decisions. If you have any health concerns, symptoms, or questions, consult a qualified medical professional promptly.

4. User Content and Records

The App may allow you to create or store records, notes, and other wellness-related information for personal use.

You are responsible for the content you create or save in the App. You agree not to enter or store unlawful, harmful, abusive, or otherwise inappropriate content through the App.

5. Intellectual Property

The App, including its design, text, graphics, features, and other content, is protected by applicable intellectual property laws.

Except for your own personal use as permitted by these Terms of Service, you may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or otherwise use any part of the App without prior written permission.

6. App Availability

Efforts may be made to keep the App available and functioning properly, but uninterrupted operation is not guaranteed.

The App may be updated, changed, suspended, or discontinued, in whole or in part, at any time without liability to you.

No warranty is made that the App will be uninterrupted, error-free, secure, accurate, reliable, or suitable for your particular needs.

To the fullest extent permitted by applicable law, liability for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the App is disclaimed.

Use of the App may be suspended or terminated if you violate these Terms of Service or use the App in a way that may cause harm, legal risk, or misuse.

You may stop using the App at any time by discontinuing use of it and deleting it from your device.

These Terms of Service may be updated from time to time. The updated version will be indicated by the Last Updated date above. Continued use of the App after changes become effective means you accept the revised Terms of Service.

12. Governing Law

If you are a user located in the United States, these Terms of Service and any dispute arising out of or relating to these Terms of Service or the App will be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any such dispute will be subject to the exclusive jurisdiction of the state or federal courts located in California, except where applicable consumer protection law provides otherwise.

If you are a consumer residing in the European Union, you may benefit from any mandatory provisions of the laws of your country of residence. Nothing in these Terms of Service limits or excludes any rights you may have under applicable consumer protection laws.

If you are located outside the United States and the European Union, these Terms of Service will be governed by the applicable laws of your country or region of residence to the extent required by local consumer protection law. In all other cases, the laws of the State of California will apply, without regard to conflict of law principles.
